In these Terms and Conditions:
(a) “the company” means TCS The Carpet Specialists
(b) “the customer” means any customer of the company
These Terms and Conditions shall apply to all contracts for the sale of Goods by the Company to the customer to the exclusion of all other terms and conditions including terms and conditions which the Customer may purport to apply under the purchase order confirmation of order or similar document. All orders for Goods shall be deemed to be an offer by the customer to purchase Goods under these Terms and Conditions. Acceptance of delivery of the Goods shall be deemed conclusive evidence of Costumer’s acceptance of these Terms and Conditions. Any variation to these terms and Conditions shall be inapplicable unless agreed in writing by the Company.
Whilst every effort will be made to provide adequate notice of any price increases, list prices may be subject to alteration without notice. All prices are subject to the addition of Value Added Tax (at the ruling rate).
Unless otherwise agreed payment of goods is due 30 days NET from date of invoice. If the Customer fails to make payment on the due date then without prejudice to any of the Company’s other rights the Company may suspend or cancel deliveries of any Goods due to the Customer and/or apprioprate any payment made by the Customer to such of the Goods as the Company may on its sole discretion think fit.
The company will exercise every endeavour to meet promised despatch dates but any dates quoted should be regarded as estimates only, and the Company shall not be liable for any loss or damages caused by and delivery being made after the quoted date including any consequential loss or damages from that delay. Acceptance and completion of an order is subject always to goods which have been ordered being available.
The Customer should inspect goods immediately upon delivery and will be required to give notice to both the Company and Carrier in the event of damage to goods in transit within 7 days. If fitting has commenced the Company will take the view that the customer has accepted the goods as satisfactory, Non delivery of goods must be notified with 14 days of the date of invoice otherwise claims cannot be accepted. The customer shall make all arrangements necessary to take delivery of the goods whenever they are tendered for delivery.
The company will only accept the return of goods provided it has agreed to do so. No fitted carpets will be collected.
Due to the nature of the business no items customer may have ordered which are under 3 linear metre will be considered for collection.
All returns must be suitably wrapped upon collection.
We cannot guarantee colour or texture match between different batches of 4 & 5 metre widths. Ideally fit the installation using one width.
All dimensions are approximate and slight variations are unavoidable. The Company shall have ve deemed to have fulfilled its contract if actual dimensions are + or – 1.25% of quoted width and length. This complies with British Standard.
All plain carpets rolled onto a tube for delivery can and will have a pressure line when unrolled where the tube has been. This is not a fault and the line will dissapear giving time. No complaints of this nature will be considered.
Under no circumstances will TCS the Carpet Specialists reimburse any fitting or uplifting costs once we have agreed to replace the faulty material.
In the event of any circumstance contingency or force majeure occurring beyond the control of the Company preventing impelling or interfering with the despatch of the whole or any part of the Goods the Company reserves the right to suspend and/or cancel delivery without incurring liability for the direct or consequential loss, injury or damages which may caused or sustained by the customer and/or and third party in consequence of any such suspension and/or cancellation.
The law applicable to the interpretation and enforcement of these Terms and Conditions shall be English Law.
